By using the Website and related Services, you give explicit consent to Nexus Volleyball Inc. for the collection, use, disclosure and retention of your personal information by us, as described in this Privacy Policy and our Terms and Conditions.

2. PERSONAL INFORMATION PROTECTION AND ELECTRONICS DOCUMENTS ACT
This Privacy Policy has been developed to meet the standards set out in Canada’s Personal Information Protection and Electronic Documents Act (“PIPEDA”) and similar provincial legislation. The Privacy Policy describes the principles the Company will use to protect the privacy of personal information it possesses about you, and institutes fair and principled information management practices with respect to personal information collected, used, or disclosed by us. The Privacy Policy informs customers, clients, and the general public how we manage personal information.
Principles of PIPEDA.

PIPEDA requires a common sense “reasonable person” approach to requesting, authenticating, and retaining personal information as a part of our business activities. We understand how sensitive confidentiality, particularly in a time when there have been highly publicized cases where breaches of such confidentiality have led to the unauthorized release of and access to confidential information of individuals. We strive to understand what customers and clients deem to be reasonable and then implement such principles in this Privacy Policy.

  • the information was originally collected without consent, express or implied, in circumstances where collection with the knowledge and consent of the individual would compromise the availability or accuracy of the information and the collection was reasonable for the purposes of investigating a breach of an agreement or a contravention of federal or provincial law;
  • it has reasonable grounds to believe the information could be useful in the investigation of a contravention of federal, provincial or foreign law, that has been, is being, or is about to be committed, and the information is used for the purpose of investigating that contravention;
  • it is used with respect to an emergency that threatens the life, health or security of an individual;
  • it is used for statistical, or scholarly study or research purposes, under limited conditions approved by the Privacy Officer; and/or
  • the information is publicly available and is specified by the Regulations to PIPEDA.

PIPEDA further authorizes Rocket Basketball.ca to disclose personal information without the knowledge or consent of an individual in circumstances including if such disclosure:

  • is made, within the Province of Quebec, to an advocate or notary or, in any other province, a barrister or solicitor who is representing it;
  • is for the purpose of collecting a debt owed by the individual to Nexus Volleyball Inc., or others for which it has been engaged to collect;
  • is required to comply with a subpoena or warrant issued, or an order made by a court, person or body with jurisdiction to compel the production of information, or to comply with rules of court relating to the production of records;
  • is made to a government institute that has identified its lawful authority to obtain the information, and which has indicated:
    • it suspects the information relates to national security, the defense of Canada, or the conduct of international affairs;
    • disclosure is requested for the enforcement of federal, provincial or foreign law, carrying out an investigation relating to such enforcement, or gathering intelligence for the purpose of such enforcement; or
    • disclosure is requested for the purpose of administering a federal or provincial law;
  • is made to an investigative body or government institution on the initiative of Nexus Volleyball Inc. and relates to a breach of an agreement or a contravention of federal, provincial or foreign law; or where the Company suspects the information relates to national security, the defense of Canada or the conduct of international affairs;
  • is made because of an emergency that threatens the life, health or security of an individual and Rocket Basketball.ca informs the individual without delay of the disclosure; and/or
  • is made for statistical or scholarly study and research purposes, under limited conditions, approved by the Privacy Officer of Rocket Basketball.ca.

Transfer of your personal information to third parties:
We may disclose your personal information to third parties in accordance with this Privacy Policy and applicable legislation and regulations. As further described under Section 6 of this Privacy Policy, we will not disclose your personal information to third parties for their marketing purposes without your explicit consent. We may share your personal information with:

  • Service providers with whom we have entered into an agreement to help us provide our Services on the Website, such as financial service providers, marketing agencies and technical support. In such cases, the personal information shall remain under the control of Rocket Basketball.ca.

6. PROTECTION AND RETENTION OF YOUR PERSONAL INFORMATION
We use all commercially reasonably efforts to protect your personal information. We have comprehensive security controls to protect against unauthorized use, alteration, duplication, destruction, disclosure, loss or theft of, or unauthorized access to, your personal information. We make great efforts to keep your personal information secure.

The Website is controlled, operated, and administered by Rocket Basketball from within the Province of Alberta, Canada. By accessing the Website, you acknowledge and agree that all matters relating to your access to, or use of the Website is be governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. You submit to the non-exclusive jurisdiction of the courts of the Province of Alberta with respect to all matters relating to these terms and conditions and your access and use of the Website and the Content.

Personal information will be collected, used, retained, and disclosed in accordance with the laws of Canada, and specifically the laws of the province of Alberta. This policy is governed by the laws of Canada and applicable provincial law. By submitting personal information to us, you understand that your personal information will be subject to the laws of Canada and applicable provincial laws.

Abuse and Unsolicited Commercial communications (“spam”)
We do not tolerate abuse of our Website. You do not have permission to add other Company members to your mailing list (e-mail or postal) for commercial purposes, even if a member has responded to your posting to solicit your business or retain your services, unless the member has given his or her explicit consent. If you notice that someone is abusing our Website (spam or spoof emails), please Contact Us immediately.

It is not allowed to use our member-to-member communication resources to send spam or content that violates our Terms and Conditions in any other way. For your security, we may, but shall not be obligated to, scan messages automatically and check for spam, viruses, phishing and other malicious activity or illegal or prohibited content. We shall be permitted to delete, block or restrict deliver or any messages deemed spam, viruses or similar such messages. We do not permanently store messages sent through these resources.
